Abstract
Os mecanismos processuais trazidos pela Lei 9.099/95 devem ser aplicados aos imputáveis e semi-imputáveis, porque lhes negar tais direitos seria aplicar uma sanção penal mais severa do que às aplicadas aos imputáveis. Mesmo sem previsão na lei para tal aplicação, deve-se fazer uma leitura Sistêmica e estender tais direitos para todas as pessoas.
