Abstract

Objective: To address the high cost of the Nusinersena medication and to analyze the influence of the judicialization of the medication in the scope of health. Bibliographic Review: Nusinersena was the first drug approved to treat Spinal Muscular Atrophy. In view of the high cost of this medication, the patient resorts to the Unified Health System, and when it has this right denied and, if it sees no alternatives, they turn to the Judiciary, as a way to interfere and mediate the right that was injured to safeguard your health and guarantee your right to life. Seeking to enforce the legislation, and especially the fundamental right, in force in the constitutional scope, by the Municipalities, States and Union. Final considerations: We can see that it is extremely important to have a better articulation between the legal and health sectors in order to reach a consensus among all those who work in favor of judicialization, ensuring that the patient receives the appropriate treatment, as needed.
