Abstract
A introdução do princípio da precaução no Direito Ambiental através da Constituição Federal de 1988 tem por objetivo prevenir o dano e não somente reprimi-lo, isto é, a tentativa de aplicar a norma somente após a degradação ou modificação prejudicial ao meio ambiente. O resultado esperado é a antecipação da tutela penal ambiental.
